R.MEDINA and its affiliates provide their services to you subject to the following terms, conditions and provisions (“Terms and Conditions”). By accessing, viewing, or using this site, you indicate that you understand and intend these Terms and Conditions to be the legal equivalent of a signed, written contract, and you accept and agree to be bound by these Terms and Conditions. Medical Depot Shop reserves the right to change these Terms and Conditions at any time for any reason. Continued use of this site following any modifications will be deemed to constitute acceptance of any such modifications.

Unless otherwise indicated, all content on this site, including text, graphics, images and logos, is the property of Medical Depot Shop or its content suppliers and is protected by Philippine and international copyright laws and regulations. License. These Terms and Conditions provide you with a personal, revocable, nonexclusive, nontransferable license to use this site provided you are in compliance with these Terms and Conditions. You may use this site only for your personal, noncommercial use. You may download a single copy of the materials from this site only for personal, noncommercial home use, as long as you agree not to remove any copyright, trademark, or other proprietary notices from the materials downloaded. The laws of the Philippines will govern these Terms and Conditions (without giving any effect to the principles of conflicts of laws) as such laws are applied to agreements entered and to be performed entirely within the Philippines by its residents. Any action to enforce these Terms and Conditions will be brought in the Philippine courts presiding in the National Capital Region, and all parties expressly agree to be subject to the jurisdiction of such courts. This site is controlled and operated by Medical Depot Shop from its offices within the Philippines. Medical Depot Shop makes no representation that materials in this site are appropriate or available for use in other locations, and access to them from territories where any of the contents of this site are illegal is prohibited. Medical Depot Shop makes no representation that the products and services available for sale or use on this site are appropriate or available for use in other locations, and use or purchase of such products or services from territories where such purchase or use is illegal is

These Terms and Conditions, together with Medical Depot Shop’s shipping policy, privacy policy, returns policy, warranty policy, security policy, contest rules, gift certificate rules, and other rules and policies posted on the site, which are hereby incorporated as if set forth fully in these Terms and Conditions, constitute the entire agreement between you and Medical Depot Shop with respect to your use of and material available through the site, and they supersede all prior or contemporaneous communications and proposals between you and Medical Depot Shop with respect to this site. Any rights not expressly granted in these Terms and Conditions are reserved.

General. In the event that any provision contained in these Terms and Conditions is held by a court of competent jurisdiction to be contrary to any law, the remaining provisions of these Terms and Conditions will remain in full force and effect. No joint venture, partnership, employment, or agency relationship exists between you and Medical Depot Shop as a result of these Terms and Conditions or your use of this site. The waiver by Medical Depot Shop of one breach or default under these Terms and Conditions shall not constitute the waiver of any subsequent or other breach or default.

RETURN AND REFUND POLICY
Returns and Replacement :
If the shopper is not satisfied with any product purchased by reason of a defect or incorrect item shipped, he/she may be entitled to either be refunded or have the product repaired or replaced.
For qualified returns, Medical Depot Shop might offer an alternative product. However, an exact product replacement cannot be guaranteed at all times; should this not be possible we will issue a full refund.

Refunds
Refunds will be processed within 14 business days after qualified returns verification.

CANCELLATION POLICY

Medical Depot Shop has the right to cancel an order at any time due to typographical or unforeseen errors that results in the product(s) on the site being listed inaccurately (having the wrong price or descriptions etc.)

Payment Complete Orders
In the event of cancellation occurs and payment for the order has been received, Medical Depot Shop shall issue a full refund.

Pending Payment Orders
Medical Depot Shop has the right to cancel an order if the shopper fails to process the payment within 7 business days after order date or if the shopper fails Medical Depot Shop validation or security authentication.

Returns/Repairs/Replacements

1. Return Policy: All returns must be done in accordance with the instructions set out in the Return Policy. Seller is not obliged to agree to any return unless all such instructions are followed to Medical Depot Shop’s satisfaction. Should Seller agree to the return, Seller will deliver the replacement Product to your specified address.
2. Permitted returns: Subject to Clause 1, within 14 working days from the date of delivery of the Product, you may return a Product when you:

1. receive a product that is fundamentally different in nature from the Product specified in the Customer Contract;
2. receive a faulty or damaged Product;
3. receive a product that is not as advertised on the platform;
4. wrong item is delivered;
5. receive a product that has missing parts/items; or
6. receive a product that does not fit (for fashion items).

3. Repair, replacement or price reduction: As an alternative to returning faulty or damaged Products under Clause 2, a Customer may request for a repair or replacement of such Products. Such request shall be irrevocable upon notification of the request to Medical Depot Shop and the Customer may not later elect for a return under Clause 2. Where the Products have not been repaired or replaced within a reasonable time, Medical Depot Shop may, at its sole discretion, grant to the Customer a reduction of the price in proportion to the reduced value of the Products, provided that under no circumstance shall such reduction exceed 15 per cent. (15%) of the price of the affected Products. Upon repair, replacement or price reduction being made as aforesaid, the Customer shall have no further claim against Seller.
4. Replacement Products: When Medical Depot Shop has provided replacement Products or given the Customer a refund, the non-conforming Products or parts thereof shall become Seller’s property and upon request such Products or parts thereof should be shipped back to Seller.
5. Risk of damage or loss: Risk of damage to or loss of the Products shall pass to the Customer at the time of delivery, or if the Customer wrongfully fails to take delivery of the Products, the time when Seller (Medical Depot Shop) has tendered delivery of the Products.
6. In cases where the customer refuses to take possession of the product without sufficient cause or justification, or returns the item without sufficient cause or justification, as provided under this Clause, Medical Depot Shop will safely keep the item for a period of fourteen (14) days, reckoned from the date Medical Depot Shop receives the product from customer. After the lapse of such period, the product or item is deemed abandoned by customer, and Medical Depot Shopmay dispose of the product or item. Notwithstanding the foregoing, Medical Depot Shop will use its best efforts to return the product to the Customer within the time frame provided.

Payment

1. General: You may pay for the Product using any of the payment methods prescribed by Medical Depot Shop from time to time. When you place an Order, actual payment will be only charged upon Seller’s acceptance of your Order and formation of a Customer Contract. All payments shall be made to Medical Depot Shop, either accepting payment in its own right. You acknowledge that Medical Depot Shop is entitled to collect payments from you.
2. Additional terms: The payment methods may be subject to additional terms as prescribed by Medical Depot Shop from time to time.
3. Payment methods: You agree that you are subject to the applicable user agreement of your payment method. You may not claim against Medical Depot Shop, for any failure, disruption or error in connection with your chosen payment method. Medical Depot Shop reserves the right at any time to modify or discontinue, temporarily or permanently, any payment method without notice to you or giving any reason.
4. Invoicing: Seller may invoice you upon the due date of any payment under a Customer Contract.
5. Failure to pay: If the Customer fails to make any payment pursuant to the terms and conditions of the payment method elected or payment is cancelled for any reason whatsoever, then without prejudice to any other right or remedy available to Seller, Seller shall be entitled to cancel the Customer Contract or suspend delivery of the Products until payment is made in full.

6. Refund of Payment:

• All refunds shall be made via the original payment mechanism and to the person who made the original payment, except for Cash on Delivery, where refunds will be made via bank transfer or store credit into the individual’s bank account provided that complete and accurate bank account details are provided to us.
• We offer no guarantee of any nature for the timeliness of the refunds reaching your account. The processing of payment may take time and it is subject to the respective banks and/or payment provider internal processing timeline.
• All costs associated with the refund process imposed by the processing bank and/or payment provider shall be borne by us.
• All refunds are conditional upon our acceptance of a valid return of the Product.
• We reserve the right to modify the mechanism of processing refunds at any time without notice.
